Pre-Production Stages :

 

Constitutions :

  • Proprietorial

  • Partnership - Need to register the deed of partnership with help a Lawyer under the provision of Act.

  • Pvt Ltd/Ltd Company : Need to register your company with Registrar of Company at Shillong under the Companies Act,1956 and have to appoint a CA for the purpose, which required :

  • Approval of the name from the Register of Companies Affairs

  • Submission of Article of Association and memorandum

  • GOT REGISTRATION AS A PRIVATE LTD/LTD COMPANY.

  • Co-operative : Need to register with the Registrar of Co-operative Society of Assam under the provision of the Act.

Preparation of Project Report :

  • Needs to appoint a consultant for the purpose.

  • If turnkey Project, needs to appoint the Project Consultant and signing of a MOU for the purpose.

Industrial Licensing/registration :

        All Industrial undertakings are exempt from obtaining an industrial license to manufacture, except for

            (i) industries reserved for the Public Sector

            (ii) industries retained under compulsory licensing

            (iii) items of manufacture reserved for the Small Scale Sector and

            (iv) if the proposal effects locational restriction.

    1. Industrial Entrepreneurs Memorandum (IEM)

      All industrial undertakings exempt from the requirements of industrial licensing or where the investment of plant & machinery is more than Rs.100.00 lakhs, need to file information in the prescribe application form. The form is available with the "Secretariat for Industrial Assistance (SIA), Department of Industrial Policy and Promotion , Udyog Bhawan , New Delhi - 110 011" and can also be down load from the Web Site of the SIA (http://www.nic.in/indmin). A computer acknowledgement containing the SIA Registration Number will be issued across the counter immediately if delivered in person or sent by post if received by post. No further approval from SIA is required.

    2. Industrial Licence :

      All industrial undertakings subject to compulsory industrial licensing are required to submit an application in prescribe form. Licenses are granted under the provisions of the Industrial (Development and Regulation) Act,1951. The form is available with the "Secretariat for Industrial Assistance (SIA), Department of Industrial Policy and Promotion, Udyog Bhawan, New Delhi - 110 011" and can also be down load from the Web Site of the SIA ( http://www.nic.in/indmin). The approval will normally be available within 4-6 weeks of filing the application.

  1. SSI Registration : All industries falling within the purview of the Small Scale sector shall apply for provisional registration certificate at the District Industries & Commerce Centres located in all district Head Quarters of Assam. The application form along with a project report/ scheme/ project profile along with the other requirement should submitted to the General Manager, DI&CC for registration.]

 

LAND/ SHED PROVIDED BY THE INDUSTRIES DEPARTMENT

  • Apply to the General Manager DI&CC for allotment of land/ shed etc in a prescribed format for the areas falls within their jurisdiction.

  • If falls within the limit of AIIDC Ltd , apply for allotment of land/ shed in prescribe format.

  • If falls within the limit of AIDC Ltd/ ASIDC Ltd , apply for allotment of land/ shed in prescribe format.

ARRANGEMENT OF PLANT & MACHINERY

  • Need to arrange plant and machinery

  • Collection of quotations

  • Plant visit and selection of machinery

  • In case of imported machinery, necessary arrangement for Import licenses, Custom Clearance, selection of transshipment agents' etc. as applicable.

NOC FROM POLLUTION CONTROL BOARD:

  • Need to apply for NOC from the Pollution Control Board of Assam in prescribe format.

  • [Three Acts in existence like - Water prevention & Control of Pollution Act,1974, The Air (Prevention & Control Pollution) Act,1981 and Environmental (Prevention and Control of Pollution) Act,1986.]

FACTORY LICENSE

  • If falls within the purview of the factories Act,1948 , need to apply for factory license in prescribe format.

BOILER LICENSE

  • If a boiler is proposed to be installed for production , need to be register with the Chief Inspector of Boiler under the provision of the Act.

EXPLOSIVE LICENSE

  • Need to obtain necessary Explosive License from the competent authority (Controller of Explosive) for any explosive substances to be used for production process.

POWER CONNECTION

  • Need to be apply to the local AEE of ASEB for power sanction in prescribed format.

  • Need to be informed to the authority to connect the power as per requirement.

  • For DG set installation, necessary application to be submitted to the Additional Chief Engineer (D), ASEB for permission.

FINANCIAL ASSISTANCE:

  • Need to be apply to the Financial Institution/ Banks/ NSIC Ltd/ NEDFi etc for sanction of Term Loan/ Working capital Loan.

  • Need to be apply to AIDC Ltd/ ASIDC Ltd / DI&CC for equity/ margin money etc.

RAW MATERIALS

  • Need to arranged the raw materials and to create a net-work of supply of raw materials at the time of production.

  • If imported need to obtain import license for the purpose

  • For food processing industry - CFTRI, Mysore

  • For Plastic - CIPET

  • Leather - CLTRI

  • DGS&D Registration

  • Export arrangement , obtained approval from various Export Promotion Councils etc.

  • Need to apply for BIS, AGMARK, FPO, ISO-9000 series if necessary.

  • Need to apply for Trade License from the local authority under the provision of the Act.

RETURNS

  • Need to submission of statutory returns on monthly/quarterly/six monthly/ Annually to the concerned authority as per provision of the Acts.

MARKETING AND SELLING ARRANGEMENT

  • Creation of a marketing net work - customer, vendor, raw material supply etc.

  • Need to registered with the DGS&D, NSIC, DI&CC, ASIDC Ltd etc for marketing assistance
